Terms of Service for Fathom1K
Effective Date: March 27th, 2025
Welcome to Fathom1K. These Terms of Service (“Terms”) govern your access to and use of the Fathom1K reservation software platform, including our mobile and web applications, website (fathom1k.com), and all related services (collectively, the “Platform”), operated by Fathom1K, Inc., a Delaware corporation (“Fathom1K,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
1. Overview of the Platform
Fathom1K is a reservation software platform designed for watersports and activity-based businesses. Operators use the Platform to manage bookings, availability, customer communications, payments, and other business operations.
2. Operator Accounts
To use the Platform, you must register an account and provide accurate and complete business information, including contact details, banking information, and legal documentation as needed.
You are responsible for:
- Maintaining the confidentiality of your account login
- Ensuring your information is accurate and up to date
- All activity conducted under your account
We reserve the right to suspend or terminate accounts that violate these Terms or fail to maintain accurate business information.
3. Customer Payments and Payouts
Fathom1K uses Stripe as its integrated payment processor. All payments from customers are processed securely through Stripe and held temporarily in a connected account before being paid out.
Payouts to operators are processed on a rolling 2-day basis as reservations are made, regardless of fulfillment date. This model aligns with industry standards for reservation platforms.
Fathom1K is not liable for delays in payouts caused by Stripe, banks, or third-party processing errors.
4. Subscription Fees and Pricing
Fathom1K charges a standard platform fee of 6% per booking, deducted automatically at the time of transaction. This includes access to the core booking system, calendar tools, payment processing integration, and reporting.
Additional services or tools may be offered separately, and fees will be disclosed in advance.
Fathom1K reserves the right to modify pricing, with advance notice provided to all users.
5. Platform Access and Availability
We aim to maintain 99.9% uptime of the Platform. However, access may be limited during scheduled maintenance, updates, or outages beyond our control.
We are not liable for losses resulting from platform downtime, internet connectivity issues, or third-party service interruptions.
6. Acceptable Use
You agree not to use the Platform for any unlawful, fraudulent, or abusive purpose, including but not limited to:
- Misrepresenting your identity or business
- Submitting false bookings
- Circumventing Stripe’s payment processing
- Interfering with system functionality
Fathom1K reserves the right to suspend or terminate access for any conduct that violates these Terms or applicable laws.
7. Data and Privacy
Your use of the Platform is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal and customer data.
By using the Platform, you consent to data practices as outlined in the Privacy Policy.
8. Intellectual Property
All content, features, code, and branding within the Platform are the property of Fathom1K, Inc. or its licensors. You may not copy, reverse-engineer, modify, or distribute any part of the Platform without our written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Fathom1K, Inc. and its affiliates shall not be liable for anyindirect, incidental, special, or consequential damages, including but not limited to:
- Loss of revenue, bookings, or customers
- Errors in payment processing
- System downtime or unavailability
- Disputes between operators and customers
- Business losses related to cancellations, refunds, or weather events
Your sole and exclusive remedy for dissatisfaction with the Platform is to stop using the service and terminate your account.
10. Termination
You may cancel your account at any time by providing written notice. We may suspend or terminate your access for violation of these Terms or misuse of the Platform.
Upon termination, access to the account and historical data may be restricted or deleted in accordance with our data retention policy.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
